I don't know about that, Don -- "can be read" by assistive technologies is different from "is read". Apple's OSX was a good example - before VoiceOver they could claim that they complied with 508 because they adhered to the Apple Accessibility API. That's an extreme example, but there are more subtle issues related to MSAA that application developers deal with regularly. Naturally the desire is to have it work with screen readers, but that is about serving the users, not meeting 22l.
